Treats Terms & Conditions

Thank you for choosing us for your special event!

 

 

Terms and Conditions Retainers, Deposits, Payments & Taxes

​

  • The date of the event is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the treats, delivery charges, and signed contract. NO refunds or transferable payments will be issued under any circumstance.

  • The final payment is due 2 weeks before the event.

  • If the final payment is missed there will be an additional 25% charge to the total that is due if the order wanted and is processed by With Love Sweet Boutique.

  • The date of your final payment is the final date for any changes of quantity, style, or flavors of the treats. Any changes requested after the date cannot be guaranteed and may be subject to additional charges.

  • When booking to ensure availability With Love Sweet Boutique ask for clients to inquire at least 3 weeks to a month in advance.

  • Last minute orders are only accepted if time is allowed.

  • If the treat order is accepted booked a week or less before the event, the deposit will equal total cost of the order and include a $50 rush fee with full payment due upfront.

  • If the Client fails to make payments, With Love Sweet Boutique will cease work, the order will be cancelled, and no refund will be given.

  • Methods of payment: Debit/Credit Card via site, PayPal, Zelle, Apple Pay or CashApp ONLY.

  • Late payments or last-minute orders are non-refundable.

  • Delivery and setup are an additional cost.

Liability

​

  • With Love Sweet Boutique is not responsible for bodily injury, property or consequential damages, which may result from services.

    • Treats may contain decorative toppings or material.

  • With Love Sweet Boutique is not responsible for any damages to the treats or shortage of treats caused by anyone NOT employed by With Love Sweet Boutique.

  • With Love Sweet Boutique will not deliver/release any treats if payments have not been paid.

 

Fulfillment of Contract

​

  • With Love Sweet Boutique is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond With Love Sweet Boutique’s control.

  • If With Love Sweet Boutique has completed the treats but it cannot be delivered due to uncontrollable circumstances the Client will be refunded on a case-by-case situation at the discretion of With Love Sweet Boutique.

  • With Love Sweet Boutique no longer assumes any responsibility for damages caused to the products after the delivery or released to client.

  • It is the client’s responsibility to make sure the items are correctly being transported-please ask for any tips you may need.

 

Postpone/Cancellation

 

  • The Client must notify With Love Sweet Boutique if there is a change in the date of the event or a complete cancellation.

  • In the event of cancellation, payments and deposits are non-refundable and will NOT be issued under any circumstances, unless With Love Sweet Boutique see it feasible to do so.

  • NOTE: If With Love Sweet Boutique give client a refund, the client cannot keep the treats. The client may only get the refund if client refuse to “accept” the treat(s). With Love Sweet Boutique will not negotiate a partial refund if the client decides to keep the treats. This is a “take it, or leave it” policy.

  • If the cancellation is NOT made within (90 days), client will not receive credit or any type of refund. No refunds and or nontransferable options will be given to move client’s deposit around to other dates. With Love Sweet Boutique LLC has every right to cancel client’s order. The client will be informed in writing and will receive the deposit back with 30 days of the cancellation.

Changes to Order

 

  • Any changes must be submitted in advance. There will be no changes allowed 2 full calendar week prior to the event. *Changes may result in price change*

Design of the Treats

 

  • With Love Sweet Boutique will follow the Client’s requests closely to create the treats desired.

  • With Love Sweet Boutique cannot and will not duplicate an exact copy of another treat artist’s work but will use it for inspiration and example for final treats.

  • With Love Sweet Boutique reserves the right to have total creative rights for the final design of the products.

 

Not happy with the order?

  • Refunds or price reduction will be based on specific information given on a case by case at the discretion of With Love Sweet Boutique.

Serving Amount & Sizes

​

  • With Love Sweet Boutique is not responsible for any overage or shortage of treats if the client’s request does not accommodate guest.

 

Allergy & Dietary Warnings

​

  • With Love Sweet Boutique baked goods may have come in contact with the following ingredients:

    • Nuts, Milk Products, Dairy, Gluten, Eggs, Pork, Wheat, or Soy.

    • Natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color and other allergens not listed.

 

  • The client is responsible for pointing out to guest’s potential allergy hazards associated with their order.

  • With Love Sweet Boutique is not held responsible for any fresh flowers that go on the treats. Fresh flowers are not edible/food products and should not be consumed as it may contain pesticides, insects, dirt, or other contaminants.

  • The client is responsible for all “non-toxic” items chosen for treat order such as disco dust and luster dust that is not edible but enhancing decorating use only.

  • For color matching With Love Sweet Boutique ask that the client provide a swatch of the shade the client would like. With Love Sweet Boutique will do the best to match the color to within 3 shades (darker or lighter). With edible products and food grade dyes exact matches are sometimes difficult to achieve. Be advised that dark colors will sometimes taste a little bitter, or stain.

Delivery and Set Up

​

  • There is a delivery fee of $25 within a 10-mileradius from our location in Concord, NC and 11-15 miles is $35 and up to 20 miles is $45.

  • A valid delivery address and directions are required 24 hours prior to delivery. Failure to provide valid address or direction, may result in treats not delivered on time, due to lack of communication and or setup on client’s part and With Love Sweet Boutique is not responsible for delay.

  • With Love Sweet Boutique is not responsible for tardiness if the venue is changed.

  • The Client may pick up the treats from Concord, NC. The Client or Client’s elective representative assumes FULL liability once it passes into the Client’s possession and out of With Love Sweet Boutique possession.

  • Performance of this agreement is contingent upon the ability of With Love Sweet Boutique LLC to complete the agreement and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control.

  • The Client is responsible for providing a suitable environment for the treats (away from heaters, vibrations, people, suitable surface while transporting, suitable outdoor and indoor setting).

  • With Love Sweet Boutique is not responsible for delivery problems associated with natural disaster or other weather conditions.

  • The Client assuming the treats means it is satisfactory. 

  • With Love Sweet Boutique is not responsible for treats including collapse, someone bumps the table, treats falls, tilt/lean, melting, pokes etc. after delivery/setup. The client is responsible for providing appropriate secure table and environment for the treats. An optimal room temperature of 72 degrees or below is best.

  • Please make sure you are transporting the treats properly on an even floor or an even chair. Best transportation is the floorboard of the car free of clutter/debris with barriers.

    • Note: If you are picking up your treats and the treats is not picked-up within a 15-20minute window from the time the client setup, there will be a $25 inconvenience/late fee applied. If a client is 20 minutes late, the client will have to reschedule pickup feasible to With Love Sweet Boutique availability. Late fee has to be paid before release of treats.

Treat Handling

 

  • All treat orders that are delivered must be set out 1-2 hours prior to the client’s event. If With Love Sweet Boutique deliver the treats and there is no place to set up the treats and the client place the treats elsewhere other than where it needs to be set up, such as a restaurant (they typically place the cake/treats in the freezer/refrigerator) if the client cut or bite into client’s treats and it’s cold/frozen, this is not With Love Sweet Boutique responsibility due to the treats not being set up where needed upon delivery at the 2 hour mark.

  • Every order is hand-made. Decorative finishes are done by hand and are subject to the artistic interpretation of our expert treat decorators.

  • The client may provide a photograph for inspiration and duplication; however, With Love Sweet Boutique make no claims for exact duplication of the work done by other treats decorators. With Love Sweet Boutique recommend the client peruse the website gallery to determine whether or not With Love Sweet Boutique style matches what the client are looking for.

  • With Love Sweet Boutique are not responsible if client’s treats are not consumed/served in this manner and results in less servings than agreed upon.

 

Photographs

​

  • With Love Sweet Boutique reserves the right to use all photographs of any items made by With Love Sweet Boutique for advertising or marketing purposes.

COVID-19

 

  • The safety of With Love Sweet Boutique clients and families are of upmost importance, therefore With Love Sweet Boutique have temporarily adjusted the way we do business. We also understand there may be a need to be flexible, please read below to understand the methods in place to protect clients and their investment.

    • Contactless Pickups: Curbside pickups are offered in Charlotte, NC. The client/elected representative will be required to remain in their vehicle and wear a mask covering nose and mouth, as will With Love Sweet Boutique staff. Once client’s mask is visible, we will bring your treats to your vehicle and place it in the front passenger seat.

    • Contactless Delivery: During delivery drop off, receiver must be properly wearing a mask before With Love Sweet Boutique will approach. During delivery and​ set up, everyone present must be properly wearing a mask and maintain social distancing from the party setting up your treats. Only drop offs are offered for home deliveries, as With Love Sweet Boutique will be unable to enter client’s home: only exception will be outdoor setups.

    • COVID Refund Policy: We understand that COVID restrictions can change unexpectedly and result in last minute event cancellations and reschedules. However, all retainers remain non-refundable. Please inform With Love Sweet Boutique as soon as possible and we will assist by rescheduling client’s date or providing the alternatives on a case-by-case basis. With Love Sweet Boutique appreciate you for your understanding and flexibility during this challenging time for everyone.

 

Treats Contract Agreement & Acknowledgement

 

Your treats are very important to us. Please carefully look over the event and order details in the contract to make sure that everything is correct. If you find any mistakes, let us know immediately or if you have any questions or concerns. I do acknowledge that it is my sole responsibility as the paying client or elected representative to full check my contract to ensure all details are correct. If changes to this contract are needed, I do acknowledge that it is my sole responsibility to notify With Love Sweet Boutique LLC in writing as soon as possible of the changes. I do understand that the treat details (flavors, styles, sizes, etc.) stated on my contract will supersede any verbal or other written communications. I acknowledge, if it is not on my contract, it will not be on my treats. With Love Sweet Boutique LLC is not responsible for damage to treats resulting from sitting outside or damage resulting after treats has been picked up by client. I give some degree of artistic license concerning my treats design. I understand that my treats will be to the closest representation of agreed upon. “I agree to the terms set out in this contract and agree that I am the person responsible for all payments and decisions regarding this treats order.” If you are unsatisfied with your order upon delivery/pickup, and do not express your concerns at that time, you will not receive credit or any type of refund. If you are not there and have a coordinator or event planner, they will be your elected representative.

By executing this agreement, you accept full responsibility and liability for any and all damages after delivery, injuries or delays that occur as a result of failure to comply with these provisions. Please sign below to show that you have read the contract completely and agree to the details of your order as well as terms and conditions as stated in this contract.
